Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the CheckPulse uptime, DNS, and SSL monitoring service (the “Service”) operated by CheckPulse (“CheckPulse,” “we,” or “us”). By creating an account or using the Service you agree to these Terms.

// 1. Account

You must be at least 16 years old and have legal capacity in your jurisdiction to enter into a contract. You are responsible for keeping your password confidential and for everything that happens under your account. Notify us at [email protected] immediately if you suspect unauthorized access.

// 2. Acceptable use

You may use the Service only to monitor properties (websites, DNS records, certificates) that you own or have explicit permission to monitor. You may not:

  • Use the Service to launch denial-of-service attacks or to harass any system or person.
  • Configure abusive or excessive check intervals against targets you do not control.
  • Attempt to bypass plan limits, access another user's data, or otherwise probe the Service for vulnerabilities except through a responsible-disclosure email to [email protected].
  • Use the Service to violate any applicable law or any third party's rights.

We may suspend or terminate accounts that violate these rules.

// 3. Plans, billing, and cancellation

  • Free plan — no payment required, subject to the limits published on the pricing page.
  • Paid plans — billed monthly in advance via Stripe at the rate published on the pricing page when you subscribe. Prices are in US dollars unless stated otherwise.
  • Renewal — paid plans renew automatically each month until you cancel.
  • Cancellation — you may cancel at any time via the Billing page. Cancellation takes effect at the end of your current billing period. You retain access to paid features until then.
  • Refunds — we do not offer pro-rated refunds for partial periods. We may, at our discretion, refund a full period if the Service materially failed to function during it.
  • Failed payments — Stripe will retry. If a payment ultimately fails, your account moves to past_due and may be downgraded to Free after the period ends.
  • Price changes — we may change prices for new billing periods with at least 30 days' notice by email.
  • Taxes — prices exclude any applicable taxes, which you are responsible for.

// 4. Service availability

We work hard to keep the Service running, but we provide it on a best-effort basis without a guaranteed service level for the Free plan. For paid plans we target 99.9% monthly uptime for the dashboard and API; if you experience prolonged downtime, contact [email protected] for a service credit. Scheduled maintenance windows are announced via the status page.

// 5. Changes to the Service

We may add, change, or remove features at any time. We will not materially reduce features included in a paid plan within the period you have prepaid for. Discontinued features will be announced by email at least 30 days before removal.

// 6. Termination

You may delete your account at any time from the Account page. We may suspend or terminate your account, with notice where practical, if you violate these Terms, fail to pay, or use the Service in a way that creates risk for us or other users. On termination, your data is deleted as described in our Privacy Policy.

// 7. Your content

You retain all rights to the monitor names, URLs, and other content you provide. You grant us a limited license to process that content solely as needed to operate the Service for you (run checks, deliver alerts, render dashboards and status pages you make public).

// 8. Disclaimer of warranties

The Service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that every incident will be detected or every alert will be delivered.

// 9. Limitation of liability

To the maximum extent permitted by law, in no event will CheckPulse be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising out of or relating to the Service. Our total aggregate liability for any claim arising out of these Terms or the Service is limited to the greater of (a) the fees you paid us in the 12 months preceding the claim, or (b) USD 100. The Service is intended as an early-warning tool, not a substitute for your own operational diligence; we are not liable for the downtime of the systems you ask us to monitor.

// 10. Indemnification

You agree to defend and indemnify us against any third-party claim arising from your use of the Service, your content, or your violation of these Terms.

// 11. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. The exclusive venue for any dispute is the courts located in the State of Delaware, USA. You and we each waive the right to a jury trial and to participate in any class action.

// 12. Changes to these Terms

We may update these Terms as the Service evolves. Material changes will be announced by email and via a notice on this page at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
